General terms and Conditions of Use

Article 1 - Preamble
The present general terms and conditions of use ("GTC") apply to the Netkin Solution ("Site"). The TOU are concluded between the creator of the Site ("NETKIN") and any person wishing to access the Site and its services ("You" or "User"). The purpose of the TOU is to provide a legal framework for the Website and to define the conditions of access and use of the services by the User.
The Website is a service of NETKIN located at 6-8 rue de Milan 75009 in Paris. The GCU must be accepted by all Users and their access constitutes acceptance of these conditions. The Website reserves the right to modify the clauses of these GCU at any time in order to adapt them to changes in the Website and/or its operation. The present GTU are accessible on the Site. In case of non-acceptance of the GTU stipulated in this contract, the User must renounce access to the services offered by the Site.

Article 2 - Access to the site
Any User with access to the Internet can access the Site free of charge and from anywhere. The User has access to the registration form and to all the services of the Website.
NETKIN will make its best efforts to allow access to the Site 24 hours a day, 7 days a week, except in the event of force majeure or an event beyond NETKIN's control. The Site and its various services may be interrupted or suspended by NETKIN, in particular for maintenance purposes, without any obligation to give prior notice or justification. NETKIN shall not be held liable in the event of impossibility of access to the Website and/or use of the services.

Article 3 - Rules of use of the Internet
The User declares that he/she accepts the characteristics and limits of the Internet, and in particular acknowledges that NETKIN assumes no responsibility for the services accessible via the Internet and exercises no control whatsoever over the nature and characteristics of the data that may transit through its server center. The User acknowledges that the data circulating on the Internet is not protected, in particular against possible misappropriation. The communication of any information deemed by the User to be of a sensitive or confidential nature is done at his/her own risk.

Article 4 - Responsibilities
The content of the Site is deemed reliable. The Website does not guarantee that it is free from defects, errors or omissions. NETKIN reserves the right to correct them, as soon as these errors are brought to its attention.
Furthermore, NETKIN cannot be held responsible for the content published on the Site by the client and thus for the use and interpretation by the User of the information contained on the Site. NETKIN cannot be held responsible for the content published by the User in comments or otherwise.
NETKIN cannot be held responsible for any viruses that may infect the User's computer as a result of misuse or illegal downloading from his computer. NETKIN cannot be held responsible in the event of force majeure or the unforeseeable act of a third party.
NETKIN cannot be held responsible in the event of legal proceedings against the User as a result of the use of the Website or any service accessible via the Internet and as a result of the User's failure to comply with these GCU.

Article 5 - Intellectual property
This site is the exclusive property of NETKIN, with the exception of all documents, products, media, information, data, elements, brands, names, logos and distinctive signs integrated by the client, as well as the participating data, and the analyses and statistics derived from them.
In accordance with article L.122-5 of the French Intellectual Property Code, no reproduction, even partial, may be made of this Website without the authorization of NETKIN. Indeed, any total or partial representation of this Website by any process whatsoever, without the express authorization of the Website operator, would constitute an infringement sanctioned by article L.335-2 and following of the Intellectual Property Code.
The company names, brands and distinctive signs appearing on the Site are protected under trademark law.  The reproduction or representation of all or part of one of the aforementioned signs must be subject to prior written authorization from the holders of the brands and signs.

This Site and the terms and conditions of its use are governed by French law, regardless of the place of use. In the event of a dispute, and after all attempts to find an amicable solution have failed, the French courts shall have sole jurisdiction to hear the dispute.

Netkin Privacy and Data Protection Policy

NETKIN's commitments in terms of data protection.
Pursuant to Article 4 of the French Data Protection Act of January 6, 1978, and Article 5 of the General Data Protection Regulation of May 25, 2018 (the "GDPR"), NETKIN undertakes to guarantee a high level of protection for the personal data of its Users whose personal data it processes.
NETKIN undertakes to comply with the regulations applicable to all the personal data processing it implements. In particular, the company undertakes to respect the following principles:

In accordance with Article 6 of the French Data Protection Act of January 6, 1978, NETKIN undertakes not to process sensitive Data. Indeed, we do not collect special categories of personal data (this includes details of your race or ethnicity, your religious or philosophical beliefs, your sex life, your sexual orientation, your political opinions, your trade union membership, information relating to your health, genetic or biometric data). We also do not collect information relating to criminal offences or convictions. If you use this type of personal data on sites or applications that you make via our platform, we will not know about it.

In the case of compulsory data, if the Internet user does not respond, NETKIN may not be able to provide the products and services requested. In addition, access to your personal data is limited to employees, agents, contractors and other third parties on a need-to-know basis. Personal Data concerning minors
NETKIN does not collect or process personal data relating to children under the age of 15 without the prior consent of the parents or holders of parental responsibility for the child. Furthermore, any person who was under the age of majority at the time of the collection of his or her personal data may obtain its deletion as soon as possible.

NETKIN places only operational and security cookies on the registration platforms which do not require the consent of the Users. The cookies we deposit do not collect any information. Their sole purpose is to allow or facilitate the user's navigation on the Site. More precisely, they allow :
